General Terms of Sale

Introduction

These General Terms of Sale (GTS) define the rights and obligations of the parties regarding the sale of premium features of the Mistikee app (hereinafter "the App"), published by Matthieu Regnauld (hereinafter "the Publisher"). By purchasing access to the premium features, the user unreservedly accepts these GTS. These terms may be updated without notice, and it is the user's responsibility to check them regularly.

Article 1: Purpose

These GTS exclusively govern the sale of the premium features of the Mistikee app. The app can be downloaded and installed for free, but some features only become accessible without limitation after a one-time payment.

Article 2: Price

The price of the premium features is the one displayed in the app at the time of purchase. The Publisher reserves the right to modify prices at any time without notice, including during the period of app use. The price may vary by geographical area due to conversion rates between the euro (the Publisher's currency) and the user's currency. All displayed prices are inclusive of all taxes (VAT included), and no additional taxes or fees apply.

Article 3: Payment Methods

Payment is made by credit card. The Publisher may accept other payment methods if indicated at the time of purchase on the sales page, but this is not an obligation. The user must ensure that the chosen payment method is valid and has sufficient funds to cover the purchase amount.

Article 4: Refund Policy

No refunds are possible, except in cases of serious, manifest, and proven failure by the Publisher to comply with these GTS or the General Terms of Use (GTU). Any refund request must be made and justified by the user, and the Publisher reserves the right to evaluate the validity of the request.

Article 5: Service Delivery

Access to the premium features of the app is immediate upon payment validation. The user receives a purchase confirmation and can then use the premium features without limitation.

Article 6: Geographical Restrictions

The Mistikee app and its premium features are available for purchase in all regions where app stores allow downloads and purchases. The Publisher does not impose additional geographical restrictions.

Article 7: Use of Premium Features

The purchase of premium features grants the user unlimited access to them, subject to compliance with the GTU and these GTS. The user acknowledges that the purchase of premium features does not transfer any intellectual property rights to the Mistikee app or its components. Any unauthorized reproduction, modification, or distribution of app elements is prohibited and may result in legal action.

Article 8: Publisher's Liability

The Publisher makes every effort to ensure the availability and proper functioning of the app's premium features. However, the Publisher be held liable for service interruptions caused by technical issues, updates, or external factors beyond their control. The user acknowledges that the Publisher cannot be held responsible for data loss on the user's device or for improper app use.

In particular, the user acknowledges that it is his/her sole and entire responsibility to store his/her purchase code, which he/she will receive at the end of the purchase process. The Publisher will not be able to recover the user's purchase code if the user forgets or loses it, since the purchase code is anonymous.

In the event of serious failure to comply with these GTS, the Publisher's liability is limited to the amount paid by the user for access to the premium features.

Article 9: Purchase code sharing

Sharing the purchase code among multiple people is strictly prohibited. If the purchase code is shared in any way, the publisher reserves the right to revoke the purchase code without notice and the user will not be refunded, especially if the purchase code is shared publicly. Legal action may then be taken.

Article 10: Force Majeure

The Publisher cannot be held liable for non-performance or delay in performing any of their obligations under these GTS in the event of force majeure. This includes, but is not limited to, natural disasters, network failures, hacking, or other unforeseeable circumstances beyond the Publisher's control.

Article 11: Changes to the GTS

The Publisher reserves the right to modify these GTS at any time to adapt them to legal, technical, or commercial changes. Any modification will be applicable upon publication on the Site or app. Users are encouraged to regularly review the GTS to stay informed of updates. Continued use of the premium features after the publication of modifications constitutes acceptance of the new terms.

Article 12: Applicable Law and Jurisdiction

These GTS are governed by French law. In the event of a dispute regarding the interpretation or execution of these GTS, the parties will attempt to resolve the dispute amicably. If an amicable solution cannot be reached, the dispute will be submitted to the competent French courts, unless otherwise required by mandatory legal provisions.

Article 13: Data Protection Related to Purchases

The Publisher is committed to protecting the confidentiality of the user's personal and financial data when purchasing premium features. Payment information is processed securely through payment platforms that comply with current standards. The Publisher does not retain the user's credit card data. For more information on personal data management, users are encouraged to review the privacy policy section in the GTU.

Article 14: Right of Withdrawal

In accordance with applicable legislation, the purchase of premium features of the Mistikee app is considered the provision of digital content executed upon payment validation. Due to the digital nature of the service and its immediate access, the user expressly waives their right of withdrawal upon purchase and use of the premium features.

Article 15: Complaints and Customer Service

For any questions or complaints regarding the purchase of premium features, users can contact the Publisher's customer service at the contact email address (contact@mistikee.com). The Publisher will endeavor to respond to inquiries within a reasonable time and find amicable solutions to any disputes.
